The 8-K confirms the pricing protection, its December 31, 2023 end date, and the same-price exception. However, the filing limits the protection to customers of certain Lancium facilities, a qualifier the claim leaves out.
Confirmed in the source:
- CleanSpark entered into a Hosting Agreement with Lancium LLC on March 29, 2022
- Through December 31, 2023, Lancium will not enter into all-in fixed price agreements with more favorable fixed all-in price terms than CleanSpark's with other customers whose power draw is the same as or less than CleanSpark's
- The restriction does not apply if CleanSpark has been provided the same fixed price under its agreement
