Rule 41(a)(1)(A)(i) allows a plaintiff to voluntarily dismiss an action without prejudice\n\nby filing a notice of dismissal before the opposing party serves an answer or motion for summary\n\njudgment. Fed. R. Civ. P. 41(a)(1)(A)(i); see Carter v. United States, 547 F.2d 258, 259 (5th Cir.\n\n1977) (\u201cAs the plain terms of [the Rule] establish, a plaintiff has an absolute right to dismiss a\n\n\n\n1\n       Since a class has not been certified nor proposed for purposes of settlement, Plaintiff\u2019s\nmotion for voluntary dismissal is governed by Rule 41(a) rather than Rule 23(e). See Fed. R. Civ.\nP. 23(e) (stating that \u201c[t]he claims, issues, or defenses of a certified class [. . .] may be settled,\nvoluntarily dismissed, or compromised only with the court\u2019s approval\u201d); Stephens v. Capitol Cnty.\nMut. Fire Ins. Co., No. 1:09-cv-759, 2009 WL 10707943, at *2 n.2 (E.D. Tex. Nov. 23, 2009)\n(\u201cBecause this is not a certified class action, Plaintiffs\u2019 motion for voluntary dismissal is governed\nby Rule 41(a)(2) rather than Rule 23(e)\u201d); accord Buller v.
