Kilthau (\u201cMr. Kilthau\u201d) respectfully submits this reply\n   2\n       memorandum in further support of his pending motion which seeks appointment as\n   3\n   4   Lead Plaintiff and approval of his selection of Levi & Korsinsky, LLP (\u201cLevi &\n\n   5   Korsinsky\u201d) as Lead Counsel for the Class.\n   6\n             Mr. Kilthau timely filed his motion for lead plaintiff on February 18, 2025, and\n   7\n   8   a corrected motion on February 20, 2025, stating that he suffered approximately\n\n   9   $20,083.38 pursuant to Section 21D of the Securities Exchange Act of 1934\n  10\n       (\u201cExchange Act\u201d) in financial losses in connection with his purchase of Joint Stock\n  11\n  12   Company Kaspi.kz (\u201cKaspi.kz\u201d, \u201cKaspi\u201d, or the \u201cCompany\u201d) securities between\n\n  13   January 19, 2024 and September 19, 2024, inclusive (the \u201cClass Period\u201d). See ECF\n  14\n       Nos. 12 and 21. Mr. Kilthau filed a response on March 3, 2025. See ECF No. 23. Mr.\n  15\n  16   Kilthau\u2019s motion is the only pending lead plaintiff motion before the Court. The\n\n  17   deadline for opposing Mr. Kilthau\u2019s motion has passed and, to date, there is no\n  18\n       opposition to it.1 On March 6, 2025, the Court denied Defendants\u2019 stipulation\n  19\n  20   extending time to respond to the initial complaint. See ECF No. 25.\n\n  21         By statute, the movant with the \u201clargest financial interest in the relief sought\n  22\n       by the class\u201d is entitled to a \u201cpresumption\u201d that he or she is the \u201cmost adequate\n  23\n  24   plaintiff\u201d to serve as the lead plaintiff. See 15 U.S.C. \u00a7 78u-4(a)(3)(B)(iii). Absent proof rebutting the presumption, Mr. Kilthau\n   4\n   5 is entitled to be appointed as the lead plaintiff. See Hufnagle v. Rino Int'l Corp., No.\n   6 CV 10-8695-VBFVBKX, 2011 U.S. Dist. LEXIS 19771, at *16 -26 (C.D. Cal. Feb.\n   7\n       14, 2011), adopted, No. CV 10-1754-VBFVBKX, 2011 U.S. Dist. LEXIS 19760\n   8\n   9 (C.D. Cal. Feb. 16, 2011) (appointing the most adequate plaintiff where competing\n  10 movants failed to submit proof of unique defense).\n  11\n             Mr. Kilthau is the movant with the largest financial interest, claiming a loss\n  12\n  13 of $20,083.38 on his Kaspi investment. See ECF Nos. 21-4 and 21-5. Mr. Kilthau\n  14 also satisfies the Rule 23 requirements. Mr. Kilthau\u2019s claims are typical of those of\n  15\n     other Class members because, like other Class members, he acquired Kaspi\n  16\n  17 securities during the Class Period at prices artificially inflated by Defendants\u2019\n  18 misrepresentations and/or omissions that form the basis of the Action. Moreover,\n  19\n     Mr. Kilthau\u2019s claims are based on the same legal theory and arise from the same\n  20\n  21 events and course of conduct as the Class\u2019s claims. Mr. Kilthau has further\n  22 demonstrated his adequacy by providing his education, employment, and years of\n  23\n     investing experience. See ECF No. 21-7. Mr. Kilthau considers himself to be a\n  24\n  25 sophisticated individual, having been investing in the stock market for over 20\n  26 years. Id. He resides in San Jose, California, and possesses a bachelor degree of\n  27\n     electrical engineering. Id. Id. Prior to\n   2 his business, Mr. Kilthau worked as a software engineer for Apple, Inc. Id. Mr. Kilthau is the movant for lead plaintiff that has the largest financial interest\n   6 in the Action and otherwise meets the requirements of Rule 23.
