                       SHERMAN DIVISION\n                           JUDGE SEAN D. JORDAN\n\n\n          STANDING ORDER ON MOTIONS TO SEAL IN CIVIL CASES\n\n      This Order is intended to ensure that the Court complies with governing law\n\non the presumption of public access to judicial proceedings and records, and the\n\nrequirements for permitting any document submitted to the Court to be filed or kept\n\nunder seal. Section A summarizes the legal standard that applies to motions to seal\n\ndocuments submitted to the Court. Parties should be familiar with this standard\n\nbefore seeking leave to file materials under seal. Section B sets out the specific\n\nprocedures that parties must follow when seeking leave to file materials under seal\n\nin civil cases before this Court, and supplements Local Rule 5(a)(7). This Order\n\napplies only to the filing of documents under seal in civil cases before Judge Sean D.\n\nJordan.\n\nA. Legal Standard\n\n      \u201cProviding public access to judicial records is the duty and responsibility of the\n\nJudicial Branch.\u201d Binh Hoa Le v. Exeter Fin. Corp., 990 F.3d 410, 417 (5th Cir. 2021)\n\n(internal quotation marks and citation omitted). Such records \u201cbelong to the\n\nAmerican people; they are public, not private, documents.\u201d Id. With these principles\n\nin mind, the Fifth Circuit has instructed courts to be \u201cungenerous with their\n\ndiscretion to seal judicial records.\u201d Id. at 418; see also June Med. Servs., L.L.C. v.\n\nPhillips, 22 F.4th 512, 519\u201320 (5th Cir. 2022) (explaining that the Fifth Circuit\n\n\u201cheavily disfavor[s] sealing information placed in the judicial record\u201d). When\n\n                                          1\n\fCase 4:24-cv-01048-SDJ     Document 72      Filed 12/17/25      Page 2 of 4 PageID #: 741\n\n\n\n\npresented with a motion to seal, courts must consider and protect the public\u2019s\n\n\u201ccommon law right to inspect and copy judicial records.\u201d Bradley on behalf of AJW v.\n\nAckal, 954 F.3d 216, 224 (5th Cir. 2020) (cleaned up). \u201cThis right promotes the\n\ntrustworthiness of the judicial process, curbs judicial abuses, and provides the public\n\nwith a better understanding of the judicial process, including its fairness, and serves\n\nas a check on the integrity of the system.\u201d Id. (cleaned up).\n\n      The public\u2019s common-law right is not absolute, however, and the presumption\n\nof public access can be rebutted by \u201ccompelling countervailing interests favoring\n\nnondisclosure.\u201d Binh Hoa Le, 990 F.3d at 421. Thus, courts must \u201cundertake a case-\n\nby-case, document-by-document, line-by-line balancing of the public\u2019s common law\n\nright of access against the interests favoring nondisclosure.\u201d Id. at 419 (cleaned up);\n\nsee also DePuy Synthes Prods., Inc. v. Veterinary Orthopedic Implants, Inc., 990 F.3d\n\n1364, 1369 (Fed. Cir. 2021) (\u201c[The Federal Circuit] appl[ies] regional circuit law in\n\ndetermining the applicable [sealing] standard,\u201d which is \u201csubstantially the same\n\nacross circuits: the parties seeking confidentiality must present a strong justification\n\nto overcome the presumption of public access.\u201d). This balancing should include a\n\n\u201cconsideration of less drastic alternatives\u201d to sealing entire documents. Binh Hoa Le,\n\n990 F.3d at 420. For example, where the movant\u2019s interests can be protected by\n\nredacting portions of a document, rather than sealing the entire document, courts\n\ngenerally favor redaction as a less drastic alternative. See, e.g., Mach Flynt Inc. v.\n\nVeritiv Operating Co., No. 2:24-CV-01444, 2025 WL 56333, at *2 (W.D. La. Jan. 9,\n\n\n\n\n                                           2\n\fCase 4:24-cv-01048-SDJ     Document 72     Filed 12/17/25   Page 3 of 4 PageID #: 742\n\n\n\n\n2025) (refusing to seal an entire contract where confidential pricing information\n\nappeared only in an appendix to the contract).\n\n      Litigants should understand that the standard for filing material under seal\n\nin the judicial record is not the same as the standard for designating that material as\n\n\u201cconfidential\u201d under a protective order. \u201cThat a document qualifies for a protective\n\norder under Rule 26(c) for discovery says nothing about whether it should be sealed\n\nonce it is placed in the judicial record.\u201d June Med. Servs., 22 F.4th at 521 (emphasis\n\nin original). The Fifth Circuit has admonished that \u201ccourts are duty-bound to protect\n\npublic access to judicial proceedings and records,\u201d a duty that is all too \u201ceasy to\n\noverlook\u201d in the context of stipulated sealings, and that it is inappropriate to\n\n\u201cpresume[e] that whatever satisfies the lenient protective-order standard will\n\nnecessarily satisfy the stringent sealing-order standard.\u201d Binh Hoa Le, 990 F.3d\n\nat 417\u201318.\n\nB. Procedures\n\n      A movant seeking leave to file materials under seal must file three documents,\n\nseparately and in the following order:\n\n      1.     Motion to seal (filed under seal). The motion must address the legal\n             standard governing motions to seal, as summarized in Section A above.\n             That is to say, it must include a document-by-document, line-by-line\n             balancing of the public\u2019s common law right of access against the\n             interests favoring nondisclosure. In so doing, the motion should list each\n             separate proposed redaction\u2014i.e., each discrete span of text or other\n             material that the movant seeks to redact\u2014and demonstrate that\n             redaction of such material is authorized under controlling precedent.\n\n             If the party seeks to seal an entire document, it must explain why\n             redacting portions of that document would not suffice to protect its\n             interests.\n\n\n                                          3\n\fCase 4:24-cv-01048-SDJ       Document 72     Filed 12/17/25   Page 4 of 4 PageID #: 743\n\n\n\n\n               The seal motion need not attach a proposed order. However, if a\n               proposed order is attached, it should reference each separate proposed\n               redaction on the list by number.\n\n      2.       Sealed, unredacted version of the document(s) sought to be\n               sealed. At the time the seal motion is filed, the movant should\n               separately file, under seal, an unredacted version of the document(s)\n               sought to be sealed.\n\n      3.       Public (non-sealed), redacted copy of the document(s) sought to\n               be sealed. At the time the seal motion is filed, the movant should also\n               separately file a redacted version of the document(s) sought to be sealed.\n               Only that material alleged to be sealable should be redacted. Each\n               redaction must correspond to the listed items in the seal motion.\n\n      In the unusual circumstance that a party seeks to seal an entire document, the\n\nparty. need not file the third document (a public, redacted copy). In all other\n\ncircumstances, failure to file the third document will result in the first two documents\n\nbeing stricken.\n\n      This Order supersedes Local Rule CV-5(a)(7)(E) for the filing of any sealed\n\ndocument in this Court.
