Whether discovery should be stayed pending resolution of Defendant NVIDIA\n\n 6   Corporation\u2019s Motion to Dismiss, Dkt. 33, which seeks to dismiss the entirety of Plaintiffs\u2019 First\n\n 7   Amended Complaint.\n\n 8                                                INTRODUCTION\n\n 9                Defendant NVIDIA Corporation (\u201cNVIDIA\u201d) respectfully moves the Court for a stay of\n\n10   discovery pending resolution of its Motion to Dismiss the First Amended Complaint, Dkt. 33\n\n11   (\u201cMotion\u201d). All relevant factors support staying discovery \u201cuntil Plaintiff[]s plausibly state[] a\n\n12   claim.\u201d Crema Soc., Inc. v. Apple Inc., No. 25-cv-08905-EKL, 2026 WL 686311, at *8 (N.D. Cal.\n\n13   Mar. 11, 2026).\n\n14                First, the Motion to Dismiss may dispose of the entire First Amended Complaint and render\n\n15   discovery unnecessary. NVIDIA \u201craised forceful challenges to the complaint,\u201d identifying multiple\n\n16   independent bases for dismissal of its sole count. Id. Second, \u201cdiscovery is not necessary to\n\n17   determine the legal viability\u201d of Plaintiffs\u2019 claim because the Motion challenges the sufficiency of\n\n18   Plaintiffs\u2019 allegations as a matter of law. Id. Third, considerations of judicial economy and\n\n19   conservation of party and third party resources favor a limited discovery stay. The Motion raises\n\n20   several threshold issues, each of which may independently dispose of Plaintiffs\u2019 claim. \u201c[E]ngaging\n\n21   in discovery prior to adjudication of a strong motion to dismiss would represent a potential waste\n\n22   of resources.\u201d Pereda v. Gen. Motors LLC, No. 21-cv-06338, JST, 2022 WL 19692037, at *1 (N.D.\n\n23   Cal. Mar. 15, 2022) (internal quotations and citation omitted). The Court should accordingly stay\n\n24   discovery until the Motion to Dismiss is resolved.\n\n25                                                 BACKGROUND\n\n26                In late November 2025, Plaintiffs filed this putative class action asserting a single cause of\n\n27   action under the DMCA, 17 U.S.C \u00a7 1201(a)(1). That claim alleges that in downloading videos\n\n28   from YouTube for AI model training, NVIDIA \u201cbypass[ed] technological measures that control\n                                                            1\n                              MOT. Compl.\u201d) \u00b6 14. 2\n\n 2             But a Section 1201(a) claim is limited to circumvention of access controls. 17 U.S.C.\n\n 3   \u00a7 1201(a)(1)(A). It does not apply to \u201ccopying,\u201d which Congress explicitly excluded from its\n\n 4   purview. S. Rep. No. 105\u2013190, at 12 (1998) (explaining \u201cthere is no\u201d corresponding \u201cprohibition\u201d\n\n 5   in the DMCA on the circumvention of copy controls). As Plaintiffs concede, YouTube does not\n\n 6   restrict access to their videos, which the public \u201ccan watch and listen to [ ] for free.\u201d Am. Compl.\n\n 7   \u00b6 29. Instead, they base their \u00a7 1201(a) claim on NVIDIA\u2019s alleged downloading of digital copies.\n\n 8   Id. \u00b6 58 (describing all five of the TPMs Plaintiffs accuse NVIDIA of circumventing as designed\n\n 9   \u201cto impede [ ] downloading\u201d).\n\n10             On April 6, 2026, NVIDIA moved to dismiss the entire First Amended Complaint under\n\n11   Federal Rule of Civil Procedure 12(b)(6). 3 As explained in that Motion, Plaintiffs\u2019 singular claim\n\n12   is subject to dismissal on several independent grounds. First, Plaintiffs cannot maintain an access\n\n13   control circumvention claim where, as here, they have made their works freely accessible to the\n\n14   public. Mot. at 7\u201310. Second, none of the five TPMs alleged by Plaintiffs qualify as access controls\n\n15   as a matter of law. Id. at 11\u201315. Third, each of those alleged TPMs suffer from additional\n\n16   deficiencies with respect to effectiveness, circumvention and/or their conclusory nature. Dkt. 59\n\n17   (\u201cReply\u201d) at 10\u201314. And fourth, Plaintiffs fail to allege when the claimed downloading occurred\n\n18   and which, if any, of the identified TPMs were in place at that time. Id. at 10.\n\n19\n\n20   2\n         This case is one of seven separate putative class actions Plaintiffs have filed on these grounds.\n21\n     Motions to dismiss are pending in five of those cases, with the response to the complaints in the\n22\n     other two cases not yet due. See Ted Ent. Inc v. Amazon.com Inc., Case No. 2:26-cv-01134 (W.D.\n23\n     Wash.); Ted Ent., Inc. v. Apple, Inc., Case No. 3:26-cv-02936 (N.D. Cal.); Ted Ent., Inc. v.\n24\n     ByteDance Inc., Case No. 3:25-cv-10933 (N.D. Cal.); Ted Ent., Inc. v. Meta Platforms, Inc., Case\n25\n     No. 4:25-cv-10931 (N.D. Cal.); Ted Ent., Inc. v. OpenAI Inc., Case No. 3:26-cv-02935 (N.D. Cal.);\n26\n     Ted Ent., Inc. v. Snap Inc., Case No. 2:26-cv-00754 (C.D. Cal.).\n27   3\n         This was NVIDIA\u2019s second Motion to Dismiss on these grounds. In response to NVIDIA\u2019s first\n28\n     Motion to Dismiss, Dkt. 23, Plaintiffs filed the First Amended Complaint, Dkt. 30.\n                                                        2\n                          MOT. NVIDIA therefore requests a\n\n 3   stay of discovery until resolution of its Motion to Dismiss.\n\n 4                                          LEGAL STANDARD\n\n 5          \u201cA district court has broad discretion to stay discovery pending the disposition of a\n\n 6   dispositive motion.\u201d Hamilton v. Rhoads, No. C 11-0227 RMW PR, 2011 WL 5085504, at *1 (N.D.\n\n 7   Cal. Oct. 25, 2011) (citing Little v. City of Seattle, 863 F.2d 681, 685 (9th Cir. 1988)). To determine\n\n 8   whether such a stay should issue, courts in this District apply a two-part test. Realtek Semiconductor\n\n 9   Corp. v. MediaTek, Inc., 732 F. Supp. 3d 1101, 1117 (N.D. Cal. 2024). First, the pending motion\n\n10   \u201cmust be potentially dispositive of the entire case, or at least dispositive on the issue at which\n\n11   discovery is directed.\u201d Id. at 1117\u201318. Second, the pending motion must be capable of resolution\n\n12   without additional discovery. Id. at 1118.\n\n13          In applying this test, the court must take a \u201cpreliminary peek\u201d at the merits of the pending\n\n14   motion to assess whether a stay is warranted. Id. In addition to these two factors, courts in the\n\n15   Ninth Circuit may \u201calso consider whether a stay of discovery will promote efficiency or conserve\n\n16   the parties\u2019 resources, recognizing that engaging in discovery prior to adjudication of a strong\n\n17   motion to dismiss would represent a potential \u2018waste of resources.\u2019\u201d Pereda, 2022 WL 19692037,\n\n18   at *1. All relevant factors support staying discovery until resolution of NVIDIA\u2019s Motion to\n\n19   Dismiss.\n\n20                                                ARGUMENT\n\n21     I.   NVIDIA\u2019s Motion to Dismiss Will Dispose of the Entire Case.\n\n22          The first factor supports a discovery stay because NVIDIA\u2019s pending Motion to Dismiss is\n\n23   \u201cpotentially dispositive of the entire case.\u201d Heck v. Amazon.com, Inc., No. 22-CV-03986-JSW,\n\n24   2022 WL 16579372, at *2 (N.D. Cal. Nov. 1, 2022) (emphasis in original). Courts routinely find a\n\n25   motion \u201cpotentially dispositive\u201d where, as here, it seeks dismissal of all claims in the action. Heck,\n\n26   2022 WL 16579372, at *2 (finding the first factor satisfied where the defendants sought dismissal\n\n27   of all claims); Garcia v. May 12, 2026) (Davila, J.) (same).\n\n 2           NVIDIA\u2019s Motion to Dismiss sets forth multiple independent grounds for dismissal of the\n\n 3   sole claim brought by Plaintiffs. As detailed in the Motion, Plaintiffs\u2019 decision to make their videos\n\n 4   freely accessible to the public is fatal to Plaintiffs\u2019 access control-based claim. Mot. at 7\u201310. So too\n\n 5   are Plaintiffs\u2019 own descriptions of the five TPMs they allege, which, accepted as true, establish that\n\n 6   none of those TPMs qualify as access controls sufficient to support a \u00a7 1201(a) claim. Id. at 11\u201315.\n\n 7   Further, Plaintiffs are unable to establish the effectiveness and/or circumvention of each of those\n\n 8   TPMs. Mot. at 11\u201315. And Plaintiffs fail to allege that any of the alleged TPMs were in effect at\n\n 9   the time of any of the alleged downloading. Id. at 14. In sum, the Motion to Dismiss provides\n\n10   multiple independent bases for dismissal of the singular claim asserted in the Complaint. Thus, the\n\n11   first factor tips in favor of a discovery stay.\n\n12    II.    NVIDIA\u2019s Motion to Dismiss Can Be Decided Without Discovery.\n\n13           The second factor supports a stay because no discovery is needed to decide NVIDIA\u2019s\n\n14   Motion to Dismiss, which \u201cis based solely on the allegations in the Complaint and does not raise\n\n15   any factual issues.\u201d Reveal Chat Holdco, LLC, No. 20-cv-00363-BLF, 2020 WL 2843369, at *3\n\n16   (N.D. Cal. Apr. 10, 2020). Indeed, briefing on NVIDIA\u2019s Motion to Dismiss is already complete\n\n17   and is precisely the type of motion the Court has repeatedly found to warrant a stay of discovery.\n\n18   Williams-Sonoma, Inc., 2026 WL 1301007, at *2\u20133 (Davila, J.) (staying discovery because \u201cif the\n\n19   Court grants [defendant\u2019s] Motion in its entirety, it will dispose of all claims\u201d and the motion could\n\n20   be \u201cdecided without additional discovery\u201d); Arcell v. Google LLC, No. 5:22-CV-02499-EJD, 2022\n\n21   WL 16557600, at *1 (N.D. Cal. Oct. 31, 2022) (Davila, J.) (\u201cDefendants have established that their\n\n22   motion is \u2018potentially dispositive\u2019 of the entire case, which weighs in favor of granting a stay of\n\n23   discovery until the Court issues a ruling on Defendants' motion to dismiss\u201d); Onuoha v. Facebook,\n\n24   Inc., No. 5:16-CV-06440-EJD, 2017 WL 11681325, at *1 (N.D. Cal. Apr. 7, 2017) (Davila, J.)\n\n25   (staying discovery pending a decision on motion to dismiss because, if defendant prevailed,\n\n26   \u201cPlaintiffs\u2019 claims will be dismissed\u201d and the motion \u201ccan be decided without further discovery\u201d).\n\n27\n\n28\n                                                        4\n                         MOT. Staying Discovery Will Promote Judicial Economy and Conserve Party and Third\n\n 2          Party Resources.\n\n 3          Finally, considerations of judicial economy and the conservation of party and third party\n\n 4   resources strongly favor staying discovery until the Motion to Dismiss is resolved.\n\n 5          First, the Motion to Dismiss seeks dismissal of the First Amended Complaint in its entirety,\n\n 6   and if granted, would eliminate any need for discovery. The Motion raises several threshold issues\n\n 7   that Plaintiffs must overcome to establish a claim, including whether they can maintain a \u00a7 1201(a)\n\n 8   claim based on videos which are freely accessible to any member of the public; and whether any\n\n 9   of the five alleged TPMs qualify as access controls under the law. As explained in NVIDIA\u2019s\n\n10   Motion to Dismiss, Plaintiffs cannot, and none are. Mot. at 11\u201315.\n\n11          Second, a stay is warranted to avoid imposing burdensome and potentially unnecessary\n\n12   discovery, including of third parties, before the Court determines whether Plaintiffs have stated a\n\n13   viable DMCA claim. Plaintiffs accuse NVIDIA of downloading \u201cmore than 100 million clips,\u201d\n\n14   Am. Compl. \u00b6 85, and seek to certify a putative class of \u201c[a]ll individuals and entities in the\n\n15   United States whose videos were posted on YouTube and were accessed by Defendant.\u201d Am.\n\n16   Compl. \u00b6 126. Moreover, Plaintiffs intend to seek broad third-party discovery in this case from\n\n17   YouTube, and have indicated an intent to issue separate subpoenas on YouTube in each of the\n\n18   seven cases they have filed. This burdensome and duplicative non-party discovery also weighs in\n\n19   favor of a stay until the Court resolves NVIDIA\u2019s Motion. Glass Egg Digital Media v. Gameloft,\n\n20   Inc., No. 17CV04165MMCRMI, 2019 WL 4166780, at *3 (N.D. Cal. Sept. 3, 2019) (\u201cThis Court\n\n21   is particularly concerned anytime enforcement of a subpoena imposes an economic burden on a\n\n22   non-party.\u201d (citation omitted)). Staying discovery will therefore conserve party, third party, and\n\n23   judicial resources and avoid potentially wasteful discovery into complex technical issues.\n\n24   Williams-Sonoma, 2026 WL 1301007, at *3 (staying discovery where anticipated discovery\n\n25   included extensive ESI and other burdensome discovery).\n\n26          Third, a limited stay would not unduly prejudice Plaintiffs. This case remains in its\n\n27   earliest stages. No trial date has been set. In re Nexus 6p Products Liab. Litig., No. 17-cv-02185-\n\n28   BLF, 2017 WL 3581188, at *2 (N.D. Cal. Aug. 18, 2017) (finding no undue prejudice where no\n                                                       5\n                        MOT. And the Court has neither \u201centered a scheduling order\u201d nor held a case\n\n 2   management conference. Affinity Credit Union, No. 22-cv-04174-JSW, 2023 WL 12065782, at\n\n 3   *2 (N.D. Cal. Apr. 14, 2023). NVIDIA\u2019s Motion to Dismiss is fully briefed and scheduled to be\n\n 4   heard on July 23, 2026.
