This pro rata\n\nshare is the Authorized Claimant\u2019s \u201cDistribution Amount\u201d; and (4) the\n\nNet Settlement Fund will be distributed pro rata to Authorized\n\nClaimants whose Distribution Amount calculates to $10.00 or more,\n\n(d) To encourage Authorized Claimants to cash their checks promptly,\nall distribution checks will bear the following notation: \u201cCASH PROMPTLY. Similarly, Authorized Claimants\nwho do not cash their distribution checks in any subsequent distributions, should such\n\ndistributions occur, within the time allotted or on the conditions set forth in paragraph\n\n\fCase 2:19-cv-20588-BRM-MAH Document140 Filed 05/05/26 Page 5 of 8 PagelD:\n11187\n\n50(b) of the Segura Declaration will irrevocably forfeit any further recovery from the\nNet Settlement Fund.\n\n(f) After JND has made reasonable and diligent efforts to have\nAuthorized Claimants cash their Initial Distribution checks (as provided in paragraph\n50(b) of the Segura Declaration), but not earlier than six (6) months after the Initial\nDistribution, IND will, after consulting with Lead Counsel, conduct a subsequent\ndistribution, in which any amount remaining in the Net Settlement Fund, after\ndeducting any unpaid fees and expenses incurred, will be distributed to all Authorized\nClaimants who cashed their Initial Distribution check and are entitled to receive at\nleast $10.00 from such subsequent distribution based on their pro rata share of the\nremaining funds. If any funds remain in the Net Settlement Fund, and if cost-\neffective, subsequent distributions will take place at six-month intervals.\n\n(g) When Lead Counsel, in consultation with IND, determine that\nfurther distribution of the funds remaining in the Net Settlement Fund is not cost-\neffective, the remaining finds will be donated to Legal Services of New Jersey.\n\n(h} Nonew Claims may be accepted after October 15, 2025, and no\nfurther adjustments to Claims received on or before October 15, 2025, that would\nresult in an increased Recognized Claim Amount may be made for any reason after\nOctober 15, 2025, subject to the following exception.
