Defendants may file\n\n\n\n  1\n   The parties are Co-Lead Plaintiffs Hook Chok and Dong Pan (\u201cPlaintiffs\u201d) and Defendants\n  Austin Russell and Tom Fennimore (\u201cDefendants\u201d).\n\n                                             1\n\fCase 6:25-cv-01384-CEM-NWH          Document 66       Filed 03/03/26     Page 2 of 4 PageID 526\n\n\n\n\n  a Motion to Dismiss that does not exceed thirty pages. Plaintiffs may file a\n\n  Response to Defendants' Motion to Dismiss that does not exceed twenty-five\n\n  pages.\u201d (\u201cOrder Granting Joint Motion\u201d).\n\n         WHEREAS, while the Order Granting Joint Motion expressly adopts the\n\n  agreed-upon page limits, it does not expressly reference the agreed-upon May 26, 2026\n\n  deadline for Plaintiffs\u2019 opposition brief;\n\n         WHEREAS, Plaintiffs therefore respectfully seek clarification that the Court\u2019s\n\n  Order grants the Joint Motion in its entirety, including the briefing schedule set forth\n\n  therein.\n\n  I.     MEMORANDUM OF LAW\n\n         In complex securities fraud class actions such as this one, courts routinely\n\n  approve extended briefing schedules for motions to dismiss. See, e.g., Johnson v. Luminar\n\n  Technologies Inc., No. 6:23-cv-982-PGB-LHP (M.D. Fla.) (ECF No. 12) (adopting\n\n  parties\u2019 proposed schedule providing 60 days for defendants to file a motion to dismiss\n\n  and 60 days for plaintiffs to file an opposition).2 The Parties here have agreed to a\n\n  similar schedule, providing Defendants with 60 days following the filing of Plaintiffs\u2019\n\n  Amended Complaint to file their Motion to Dismiss, and Plaintiffs with 60 days to\n\n  respond to Defendants\u2019 Motion.\n\n         The Parties\u2019 Joint Motion requested both modified page limits and a coordinated\n\n  briefing schedule reflecting the complexity of the case.
