Dkt. 112.\n\n 3            On June 5, 2024, the Court issued an Order Granting Stipulated Motion to Amend\n\n 4   Scheduling Order, granting the Parties\u2019 stipulation to change certain discovery deadlines. Dkt. 120.\n\n 5            On September 30, 2024, the Court issued a Minute Order granting the Parties\u2019 Stipulated\n     Motion to Amend the Scheduling Order by four months to resolve certain production issues.\n 6\n     Dkt. 145.\n 7\n              On October 24, 2024, the Ninth Circuit granted Zillow\u2019s 23(f) Petition (Dkt. 147) and the\n 8\n     Court entered a Minute Order on November 1, 2024, staying the case pending the resolution of\n 9\n     Zillow\u2019s Petition (Dkt. 149).\n10\n              On September 26, 2025, the Ninth Circuit entered its opinion affirming the certification of\n11\n     the class. Dkt. 151. Zillow then sought a rehearing and en banc consideration, which was\n12\n     unanimously denied in January 2026. The mandate was returned to the district court on January\n13\n     14, 2026. Dkt. 155.\n14\n              On February 19, 2026, the Court entered a Minute Order setting the current case schedule,\n15   Dkt. 157, as reflected in the Parties\u2019 Joint Status Report, Dkt. 156.\n16            On June 2, 2026, the Court granted the Parties\u2019 Stipulated Motion on the Approval of Class\n17   Notice. Dkt. 159.\n18            On June 5, 2026, Zillow filed a petition for writ of certiorari at the Supreme Court of the\n19   United States. Plaintiff filed a waiver of the right of respondent to file a response soon thereafter.\n20            On June 17, 2026, the Supreme Court of the United States distributed Zillow\u2019s petition for\n\n21   writ of certiorari for the September 28, 2026 conference.\n\n22            On June 25, 2026, the Supreme Court of the United States requested a response from\n\n23   Plaintiff, with a due date of July 27, 2026.\n              The Parties agree and jointly contend that they have met all previous case deadlines and\n24\n     have been litigating this case in a diligent and cooperative manner. Plaintiff has already taken\n25\n     eleven depositions, with another five scheduled to take place over the summer. However, the Parties\n\n 5   agree that postponing class notice until after the petition for writ of certiorari is resolved will\n     minimize confusion to class members and reduce costs should the notice be amended due to any\n 6\n     developments with Zillow\u2019s petition for writ of certiorari.\n 7\n              The Parties acknowledge that the proposed schedule continues the pre-trial and trial dates\n 8\n     originally set in the July 7, 2023 Minute Order, then amended in the December 20, 2023, June 5,\n 9\n     2024, September 30, 2024, and February 19, 2026 Minute Orders. Class A common stock or Class C capital stock during\n 8                      the period from August 5, 2021, to November 2, 2021, inclusive (the\n                        \u201cClass Period\u201d), and were damaged thereby.\n 9\n\n10               WHEREAS, Defendants filed a petition for leave to review the certification Order under\n\n11   Federal Rule of Civil Procedure (\u201cFRCP\u201d) 23(f), which was granted on October 24, 2024, see\n\n12   Order (docket no. 147), and therefore this Court entered a stay of proceedings until Defendants\u2019\n\n13   Rule 23(f) Appeal was resolved. Minute Order (docket no. 149).\n\n14               WHEREAS, the Ninth Circuit entered a memorandum opinion, docket no. 151, on\n\n15   September 26, 2025, affirming the Court\u2019s certification Order and remanded the case back to the\n\n16   district court on January 14, 2026, see Mandate (docket no. 155).\n\n17               WHEREAS, on February 19, 2026, this Court lifted the stay, entered a new case\n\n18   schedule, and directed the parties to file a joint status report on a proposed class notice plan no\n\n19   later than March 16, 2026. Minute Order at 2 (docket no. 157). The Parties, having conferred,\n\n20   stipulate and, subject to the Court\u2019s approval, agree as follows:\n\n21               1.     The Parties agree to the use of the form of the Notice of Pendency of Class Action\n\n22   (the \u201cLong Notice\u201d), the Summary Notice of Pendency of Class Action (the \u201cSummary Notice\u201d),\n\n23   and the proposed Postcard Notice of Pendency of Class Action (\u201cPostcard Notice\u201d). 1 See\n\n24   Exs. 1\u20133 (docket nos. 158-1, 158-2, & 158-3). The Parties also agree to use the proposed form\n\n25   entitled Request to be Excluded from the Class (\u201cOpt-Out Form\u201d). See Ex. 4 (docket nos. 158-4).\n\n26\n           1\n               The Long Notice, Summary Notice, and Postcard Notice are collectively referred to as the\n27\n     \u201cNotices.\u201d\n28\n     STIPULATED MOTION & ORDER FOR\n     APPROVAL OF CLASS NOTICE \u2013 1\n     No. 2:21-cv-01551-TSZ\n\f           Case 2:21-cv-01551-TSZ            Document 159         Filed 06/02/26      Page 3 of 10\n\n\n\n\n 1   The Declaration of Paul Mulholland, President of Strategic Claims Services, Inc., Regarding\n\n 2   Providing Notice of Class Certification to Members of the Class (\u201cMulholland Declaration\u201d) sets\n\n 3   out additional detail on the qualification and experience of Strategic Claims Services, Inc.\n\n 4   (\u201cSCS\u201d), as well as its proposed role in disseminating class notice in this matter. See Ex. 5\n\n 5   (docket nos. 158-5).\n\n 6          2.      The proposed form and content of the Notices meet the requirements of FRCP\n\n 7   23(c)(2)(B), as they clearly and concisely state in plain and easily understood language all of the\n\n 8   following: (a) the nature of the Action; (b) the definition of the certified Class; (c) the Class\n\n 9   claims, issues, or defenses; (d) a Class Member\u2019s right to enter an appearance through an\n\n10   attorney if the member so desires; (e) a Class Member\u2019s right to be excluded from the Class; (f)\n\n11   the time and manner for requesting exclusion; and (g) the binding effect of a Class judgment on\n\n12   members under FRCP 23(c)(3). The Notices, method, and schedule set forth below for notifying\n\n13   the Class of the pendency of the Action as a class action meet the requirements of FRCP 23 and\n\n14   of due process, constitute the best notice practicable under the circumstances, and shall constitute\n\n15   due and sufficient notice to all persons and entities entitled thereto.\n\n16          3.      Plaintiff selects Strategic Claims Services, Inc. as the Notice Administrator.\n\n17          4.      Defendant Zillow Group, Inc. (\u201cZillow\u201d) shall use reasonable efforts to, within\n\n18   twenty-one (21) calendar days after entry of this Order for Approval of Notice and Summary\n\n19   Notice and at no cost to the Class, have its transfer agent provide or cause to be provided to the\n\n20   Notice Administrator security holder records (consisting of the security holder names, addresses,\n\n21   and email addresses to the extent the transfer agent has access to them) in electronic form,\n\n22   identifying all persons or entities who purchased Zillow securities during the period from August\n\n23   5, 2021 to November 2, 2021, both dates inclusive. Class Counsel shall be responsible for all\n\n24   other costs associated with disseminating the Notices.\n\n25          5.      Not later than thirty (30) calendar days from entry of this Order (\u201cNotice Date\u201d),\n\n26   the Notice Administrator shall distribute the Notices, as outlined in the Mulholland Declaration,\n\n27   and substantially in the form of Exhibits 1\u20133 (docket nos. 158-1, 158-2, & 158-3), to be either (a)\n\n28\n     STIPULATED MOTION & ORDER FOR\n     APPROVAL OF CLASS NOTICE \u2013 2\n     No. 2:21-cv-01551-TSZ\n\f            Case 2:21-cv-01551-TSZ         Document 159         Filed 06/02/26      Page 4 of 10\n\n\n\n\n 1   emailed to Class Members for whom the Notice Administrator is able to obtain email addresses\n\n 2   or (b) mailed, by first-class mail, postage prepaid, to Class Members at the addresses set forth in\n\n 3   the records provided by Zillow\u2019s transfer agent, if no email address can be obtained, or who may\n\n 4   otherwise be identified with reasonable effort.\n\n 5          6.      The Notice Administrator shall use reasonable efforts to give notice to Nominees 2\n\n 6   such as brokerage firms and other persons and entities who may have, for the beneficial interest\n\n 7   of any person or entity other than itself or themselves, purchased Zillow securities during the\n\n 8   period from August 5, 2021, to November 2, 2021, both dates inclusive. Ex. 5 at \u00b6\u00b6 6\u20137 (docket\n\n 9   no. 158-5). Such Nominees shall, within seven (7) calendar days of receipt of the Notice, either:\n\n10                  (a) request sufficient copies of the Postcard Notice from the Notice Administrator\n\n11                  to mail to the beneficial owners and, within seven (7) calendar days of receipt of\n\n12                  those Postcard Notices, mail the Postcard Notice to all such beneficial owners; or\n\n13                  (b) request the link to the electronic copy of the Long Notice from the Notice\n\n14                  Administrator and, within seven (7) calendar days of receipt of the link to the\n\n15                  electronic Long Notice, email the Long Notice to beneficial owners; or\n\n16                  (c) provide a list of the names, addresses, and email addresses, to the extent email\n\n17                  addresses are available, of all such beneficial owners to the Notice Administrator,\n\n18                  whereafter the Notice Administrator is ordered to send the Postcard Notice\n\n19                  promptly to such identified beneficial owners.\n\n20          7.      If the Notice Administrator receives an email address for a beneficial owner, the\n\n21   Notice Administrator shall email the Notice to the beneficial owner. Nominees who elect to send\n\n22   the Postcard Notice to their beneficial owners shall send a statement to the Notice Administrator\n\n23   confirming that the mailing of the Postcard Notice and/or emailing of the link to the electronic\n\n24   Long Notice was made and shall retain their mailing and/or emailing records for use in\n\n25\n\n26      2\n          It is anticipated that a large majority of Class Members will be beneficial purchasers who\n     hold their securities in \u201cstreet name,\u201d i.e., the securities are purchased by banks, brokers, and\n27   other entities known as Nominees. Upon full compliance\n\n 2   with these directions, such Nominees may seek reimbursement of their reasonable expenses\n\n 3   actually incurred by providing the Notice Administrator with proper documentation supporting\n\n 4   the expenses for which reimbursement is sought. The reimbursement to Nominees shall not\n\n 5   exceed $0.02 per name, address, and email address provided to the Notice Administrator; $0.02\n\n 6   per link to the Long Notice actually emailed by Nominees; or $0.02 plus postage at the current\n\n 7   pre-sort rate used by the Notice Administrator per Postcard Notice mailed directly to beneficial\n\n 8   owners by Nominees.\n\n 9          8.      Contemporaneously with the mailing of the Postcard Notice, the Notice\n\n10   Administrator shall cause a copy of the Notices, substantially in the form of Exhibits 1\u20133 (docket\n\n11   nos. 158-1, 158-2, & 158-3), to be posted on the Notice Administrator\u2019s website,\n\n12   www.JaegervZillowLitigation.com. Ex. 5 at \u00b6\u00b6 5, 8 (docket no. 158-5). Class Members will be\n\n13   able to download copies of the Notices. Id. at \u00b6 8. The case website will also provide an\n\n14   overview of the case and highlight important dates, such as the Exclusion Deadline. The Notice\n\n15   Administrator will also post on the case website the proposed Opt-Out Form.\n\n16          9.      The Notice Administrator shall cause a copy of the Summary Notice, substantially\n\n17   in the form of Exhibit 2 (docket no. 158-2), to be published once in Investor\u2019s Business Daily\n\n18   and issued once over Globe Newswire, each within ten (10) calendar days of the mailing of the\n\n19   Postcard Notice. Ex. 5 at \u00b6 5 (docket no. 158-5).\n\n20          10.     The Notice Administrator will also maintain a toll-free telephone number and\n\n21   email address that will be staffed with customer service representatives trained to answer\n\n22   questions about the Action. Id. at \u00b6 8.\n\n23          11.     Class Members shall be bound by all determinations and judgments in this\n\n24   Action, whether favorable or unfavorable, unless such persons and entities request exclusion\n\n25   from the Class in a timely and proper manner, as hereinafter provided. A Class Member wishing\n\n26   to be excluded from the Class shall mail a written request by first class mail, postmarked no later\n\n27   than 60 calendar days from the Notice Date, to the address designated in the Notice. Zillow Group Inc., et al., Case No.: 2:21-cv-01551-TSZ, and it must: (i) state the name,\n\n 3   address, telephone number, and email address of the person or entity requesting exclusion; (ii)\n\n 4   state the number of Zillow securities purchased, acquired, sold, and/or disposed during the Class\n\n 5   Period, as well as the dates and prices of each such purchase, acquisition, sale, and/or\n\n 6   disposition; (iii) be signed by the person or entity requesting exclusion, or an authorized\n\n 7   representative thereof; and (iv) include account documentation reflecting the person or entity\u2019s\n\n 8   purchase and sale of Zillow securities during the Class Period. The request for exclusion shall\n\n 9   not be effective unless it provides the required information and is made within the time stated\n\n10   above, or the exclusion is otherwise accepted by the Court.\n\n11          12.     Any Class Member who retains separate counsel in connection with this matter\n\n12   must enter an appearance, as set out in the Long Notice, no later than seventy-five (75) calendar\n\n13   days after the Notice Date. Within eighty (80) calendar days after the Notice Date, Class Counsel\n\n14   will forward to counsel for Defendants any notices of appearance that were mailed to Class\n\n15   Counsel but not filed with the Court.\n\n16          13.     Class Counsel shall file with the Court proof of mailing of the Postcard Notice,\n\n17   proof of publication of the Summary Notice, and proof of posting of the Notice on the Notice\n\n18   Administrator\u2019s website within ten (10) calendar days following the Summary Notice publication\n\n19   date. Class Counsel shall also file with the Court an affidavit setting forth a list of all persons and\n\n20   entities who have validly and timely requested exclusion from the Class within fourteen (14)\n\n21   calendar days following the expiration of the exclusion deadline.\n\n22          14. Class A common stock or Class C capital stock during the\n 7                     period from August 5, 2021, to November 2, 2021, inclusive (the\n                       \u201cClass Period\u201d), and were damaged thereby.\n 8\n\n 9            WHEREAS, Defendants filed a petition for leave to review the certification Order under\n\n10   Rule 23(f), which was granted on October 24, 2024, and therefore this Court entered a stay of\n\n11   proceedings until Defendants\u2019 Rule 23(f) Appeal was resolved. Dkt. 149.\n\n12            WHEREAS, the Ninth Circuit entered a memorandum opinion on September 26, 2025,\n\n13   affirming the Court\u2019s certification Order and remanded the case back to the district court on\n\n14   January 14, 2026.\n\n15            WHEREAS, on February 19, 2026, this Court lifted the stay, entered a new case schedule,\n\n16   and directed the parties to file a joint status report on a proposed class notice plan no later than\n\n17   March 16, 2026. Dkt. 157. The Parties, having conferred, stipulate and, subject to the Court\u2019s\n\n18   approval, agree as follows:\n\n19            1.       The Parties agree to the use of the form of the Notice of Pendency of Class Action\n\n20   (the \u201cLong Notice\u201d), the Summary Notice of Pendency of Class Action (the \u201cSummary Notice\u201d),\n\n21   and the proposed Postcard Notice of Pendency of Class Action (\u201cPostcard Notice\u201d) attached as\n\n22   Exhibits 1, 2, and 3, respectively. 1 The Parties also agree to use the proposed form entitled\n\n23   Request to be Excluded from the Class (\u201cOpt-Out Form\u201d), attached as Exhibit 4. (\u201cSCS\u201d), as well as its proposed role in disseminating class notice in this\n\n 2   matter.\n\n 3             2.      The proposed form and content of the Notices meet the requirements of Rule\n\n 4   23(c)(2)(B), as they clearly and concisely state in plain and easily understood language all of the\n\n 5   following: (a) the nature of the Action; (b) the definition of the certified Class; (c) the Class\n\n 6   claims, issues, or defenses; (d) a Class Member\u2019s right to enter an appearance through an\n\n 7   attorney if the member so desires; (e) a Class Member\u2019s right to be excluded from the Class; (f)\n\n 8   the time and manner for requesting exclusion; and (g) the binding effect of a Class judgment on\n\n 9   members under Federal Rule of Civil Procedure 23(c)(3). The Notices, method, and schedule set\n\n10   forth below for notifying the Class of the pendency of the Action as a class action meet the\n\n11   requirements of Rule 23 and of due process, constitute the best notice practicable under the\n\n12   circumstances, and shall constitute due and sufficient notice to all persons and entities entitled\n\n13   thereto.\n\n14             3.      Plaintiff selects Strategic Claims Services, Inc. as the Notice Administrator.\n\n15             4.      Defendant Zillow Group, Inc. (\u201cZillow\u201d) shall use reasonable efforts to, within\n\n16   twenty-one (21) calendar days after entry of the accompanying Order for Approval of Notice and\n\n17   Summary Notice (the \u201cOrder\u201d) and at no cost to the Class, have its transfer agent provide or\n\n18   cause to be provided to the Notice Administrator security holder records (consisting of the\n\n19   security holder names, addresses, and email addresses to the extent the transfer agent has access\n\n20   to them) in electronic form, identifying all persons or entities who purchased Zillow securities\n\n21   during the period from August 5, 2021 to November 2, 2021, both dates inclusive. Class Counsel\n\n22   shall be responsible for all other costs associated with disseminating the Notices.\n\n23             5. The Notice Administrator shall use reasonable efforts to give notice to Nominees 2\n\n 4   such as brokerage firms and other persons and entities who may have, for the beneficial interest\n\n 5   of any person or entity other than itself or themselves, purchased Zillow securities during the\n\n 6   period from August 5, 2021, to November 2, 2021, both dates inclusive. Ex. 5 at \u00b6\u00b6 6-7. Such\n\n 7   Nominees shall, within seven (7) calendar days of receipt of the Notice, either:\n\n 8                     (a) request sufficient copies of the Postcard Notice from the Notice Administrator\n\n 9                     to mail to the beneficial owners and, within seven (7) calendar days of receipt of\n\n10                     those Postcard Notices, mail the Postcard Notice to all such beneficial owners; or\n\n11                     (b) request the link to the electronic copy of the Long Notice from the Notice\n\n12                     Administrator and, within seven (7) calendar days of receipt of the link to the\n\n13                     electronic Long Notice, email the Long Notice to beneficial owners; or\n\n14                     (c) provide a list of the names, addresses, and email addresses, to the extent email\n\n15                     addresses are available, of all such beneficial owners to the Notice Administrator,\n\n16                     where after the Notice Administrator is ordered to send the Postcard Notice\n\n17                     promptly to such identified beneficial owners.\n\n18            7. The Notice Administrator will also maintain a toll-free telephone number and\n\n18   email address that will be staffed with customer service representatives trained to answer\n\n19   questions about the Action. Id. at \u00b6 8.\n\n20            11.      Class Members shall be bound by all determinations and judgments in this\n\n21   Action, whether favorable or unfavorable, unless such persons and entities request exclusion\n\n22   from the Class in a timely and proper manner, as hereinafter provided. With\n\n10   the basis for the stay gone, the case should move forward.\n\n11            And yet, Defendants now seek to prolong the stay while they pursue a petition for certiorari.\n\n12   But a stay pending certiorari is an extraordinary remedy, not a procedural entitlement. It is also\n\n13   \u201cnot a matter of right,\u201d and here Defendants bear the burden of showing that the circumstances\n\n14   justify such relief. Nken v. Holder, 556 U.S. 418, 433\u201334 (2009). The most critical factors are a\n\n15   strong showing of likely success and irreparable harm. Id. at 434. Defendants satisfy neither factor.\n\n16            First, Defendants cannot plausibly claim a meaningful likelihood of Supreme Court review.\n\n17   The Ninth Circuit\u2019s decision was unanimous, unpublished, fact-bound, and reviewed under the\n\n18   deferential abuse-of-discretion standard. Defendants then failed to obtain a rehearing, and no judge\n\n19   voted for en banc review. As Judge Pechman recently explained in a case where a defendant had\n\n20   also failed to secure an appellate panel rehearing or en banc review: \u201cthere is little likelihood that\n\n21   the petition for certiorari will be granted,\u201d and that the absence of any en banc votes is \u201ca strong\n\n22   indication that the petition is unlikely to be taken up.\u201d Ngethpharat v. State Farm Mut. Auto. Ins.\n\n23   Co., 2025 WL 672730, at *1\u20132 (W.D. Wash. Mar. 3, 2025). This case presents an even weaker\n\n24   basis for certiorari, as it falls squarely within the ordinary run of Rule 23(f) securities litigation\n\n25   appeals that have a less than one percent chance of reaching the Supreme Court.\n\n26            Defendants also fail as to the second factor as they identify below no irreparable injury\n\n27   beyond the ordinary burdens of litigation. That is legally insufficient. Nken, 556 U.S. at 435;\n\n28   Ngethpharat, 2025 WL 672730, at *2 (holding that being required to litigate does not constitute\n\n     JOINT STATUS REPORT (No. 2:21-cv-01551-TSZ) \u2013 2\n                                                                               1301 Second Avenue, Suite 2000, Seattle, WA 98101\n                                                                                 (206) 623-7292 OFFICE    (206) 623-0594 FAX\n\f            Case 2:21-cv-01551-TSZ           Document 156       Filed 01/28/26            Page 3 of 9\n\n\n\n\n 1   hardship). By contrast, continued delay inflicts concrete and asymmetric harm on Plaintiffs and\n\n 2   the class. As Ngethpharat emphasized, \u201cfurther delay \u2026 does not serve the interest of justice and\n\n 3   will inject yet more delay in this aging matter.\u201d Id.\n\n 4           Finally, Defendants\u2019 conduct further undermines their request. Had they believed a stay\n\n 5   was warranted, they should have sought a stay of the mandate in the Ninth Circuit as it is \u201cfar\n\n 6   better positioned\u201d than the district court to determine whether a stay pending certiorari is\n\n 7   appropriate. Ngethpharat, 2025 WL 672730, at *1. But Defendants chose not to do so here.\n\n 8   Plaintiffs should not bear the consequences of that strategic choice.\n\n 9           On balance, the equities decisively favor lifting the stay. If certiorari is denied\u2014as is\n\n10   overwhelmingly likely\u2014the lost time cannot be recovered. If certiorari is granted\u2014an\n\n11   extraordinary event\u2014this Court retains full authority to address any resulting consequences.\n\n12   Continued suspension of proceedings on this record would serve neither judicial economy nor\n\n13   fairness.\n\n14           Defendants\u2019 Position: Defendants believe that the stay should be extended through the\n\n15   resolution of Defendants\u2019 anticipated petition for writ of certiorari in the Supreme Court. The\n\n16   Appeal raises significant issues that affect securities litigation nationwide, and, notwithstanding\n\n17   Plaintiff's characterization of the currently anticipated certiorari petition as \"weak[],\" the Court\n\n18   need not pre-judge the merits of any petition in order to decide whether to extend the stay in this\n\n19   case. Nor, contrary to Plaintiff\u2019s suggestion, do Defendants need to meet what amounts to a\n\n20   preliminary injunction standard. District courts in the Ninth Circuit stay proceedings pending\n\n21   certiorari petitions because \"a ruling on [a certiorari] petition has the potential to clarify and\n\n22   streamline the issues in this case with minimal hardship.\" Puget Soundkeeper All. v. Port of\n\n23   Tacoma, 2024 WL 4799761, at *1-2 (W.D. Wash. Nov. 15, 2024) (staying action where\n\n24   \"[a]waiting a determination on the petition will clarify the issues and questions of law for this\n\n25   litigation\" and plaintiff \"will not have to wait long to see whether its prediction that Defendants'\n\n26   petition is 'futile' comes true\"); Bank of New York Mellon v. Blackrose Invs., LLC, 2017 WL\n\n27   11883465, at *1-2 (D. Nev. Apr. 12, 2017) (staying action to \"permit the parties to present\n\n28   arguments and evidence in the context of complete and resolved precedent, and . . . allow [the\n\n     JOINT STATUS REPORT (No. 2:21-cv-01551-TSZ) \u2013 3\n                                                                              1301 Second Avenue, Suite 2000, Seattle, WA 98101\n                                                                                (206) 623-7292 OFFICE    (206) 623-0594 FAX\n\f              Case 2:21-cv-01551-TSZ          Document 156         Filed 01/28/26            Page 4 of 9\n\n\n\n\n 1   court] to evaluate the claims in light of this legal authority\"; finding \"[a]ny possible damage that a\n\n 2   stay may cause is minimal\" where the \"stay will be reasonably brief and is not indefinite\").\n\n 3            Here, the Supreme Court's consideration of the issues to be raised in Defendants' currently\n\n 4   anticipated certiorari petition has \"the potential to be dispositive of this case or at least of discrete\n\n 5   issues that it presents.\" Deutsche Bank Nat'l Tr. Co. v. Copper Sands HOA, 2017 WL 773863, at\n\n 6   *2 (D. Nev. Feb. 28, 2017). Thus, extending the stay will prevent \"unnecessary briefing and the\n\n 7   expenditures of time, attorney's fees, and resources that could be wasted\u2014or at least prematurely\n\n 8   spent\u2014should the Supreme Court take up [the case].\" Id. Further, any potential hardship or further\n\n 9   delay would be minimal. Murguia v. Langdon, No. 2023 WL 6308325, at *3 (E.D. Cal. Sept. 28,\n\n10   2023) (\"After the nearly two-year delay between the district court's order and the issuance of the\n\n11   Ninth Circuit's mandate, a brief delay pending resolution of the petition for certiorari will not make\n\n12   a greater difference in witness\u2019 memories or the loss of evidence.\"); Puget, 2024 WL 4799761, at\n\n13   *1 (finding potential damage from stay pending certiorari petition \"minimal and manageable\").\n\n14   Consequently, the most efficient course for both the Court and the Parties is to maintain the status\n\n15   quo, as the Court already recognized when it ordered the stay to remain in effect through the\n\n16   resolution of Defendants' en banc petition. (Dkt. 153.)\n\n17       B.      Class Notice Plan\n\n18            As for the class notice plan, at the time of the Stay Order, the Parties were days away from\n\n19   filing a proposed notice dissemination plan, long form class notice, summary class notice, postcard\n\n20   notice, class member opt-out form, and a declaration from the class notice administrator for the\n\n21   Court\u2019s review. Dkt. 146 at 2-3. Plaintiffs believe that class notice should proceed now that\n\n22   Defendants\u2019 Appeal has been resolved and that the class notice materials have already been\n\n23   prepared. Dkt. 149. Defendants believe that continuing with the preparation of a proposed class\n\n24   notice plan is premature until the currently anticipated certiorari petition is resolved.\n\n25       C.      Status of Discovery Prior to Stay\n\n26            Prior to the November 2024 Stay Order, the Parties were working cooperatively on\n\n27   completing discovery. Defendants substantially completed document production on January 29,\n\n28   2024, having produced over 240,000 documents. Depositions commenced in\n\n 2   July and August 2024 but were temporarily paused in September and October to allow the Parties\n\n 3   to complete a targeted supplemental production for the reasons described in the September 26,\n\n 4   2024, Stipulated Motion to Amend Scheduling Order. Dkt. 144. The Parties were planning to\n\n 5   restart depositions in November 2024, but these were cancelled due to the Stay Order.\n\n 6           Additionally, Zillow made a series of productions in November and December 2025 for\n\n 7   the reasons described in the October 2025 Joint Status Report. Dkt. 152. The Parties also expect\n\n 8   additional productions will be made over the next few months relating to the discovery issues\n\n 9   described below.\n\n10      D.      Status of Discovery Disputes\n\n11           At the time of the Stay Order, the Parties were negotiating responsiveness, burden, and\n\n12   scope related to five discovery issues: (1) outstanding Slack communications; (2) interim drafts\n\n13   from cloud-based documents; (3) outstanding video requests; (4) Zillow board of directors\n\n14   communications; and (5) privilege log entries. The Parties have worked cooperatively on all five\n\n15   issues and are close to resolving issues 1-3. The Parties will continue to meet and confer over\n\n16   issues related to (4) board of directors communications and (5) privilege log entries regardless of\n\n17   this Court\u2019s decision regarding the requested stay.\n\n18      E.      Anticipated Future Discovery\n\n19           The Parties will continue to meet and confer over the next several weeks and agree to seek\n\n20   judicial resolution of any discovery disputes if the Parties remain at an impasse by the end of\n\n21   March. If a stay is not granted, the Parties expect to substantially complete this tranche of discovery\n\n22   by May 2026 and will proceed with taking approximately 10-15 fact depositions during the\n\n23   summer.\n\n24      F.      Mediation Developments\n\n25           The Parties completed a mediation with Robert Meyer of JAMS on August 22, 2025. Proposed Schedule\n\n 2           In the event the Court declines to extend the stay, the Parties propose the below case\n\n 3   schedule, with Plaintiff\u2019s and Defendants\u2019 respective proposed deadlines in separate columns.\n\n 4           Plaintiff\u2019s Position: Defendants elected to pursue an interlocutory appeal that predictably\n\n 5   halted progress in this case for more than fifteen months. While Defendants were entitled to seek\n\n 6   appellate review, equity does not require that Plaintiffs absorb the full cost of that delay while\n\n 7   Defendants emerge with the benefit of both the appellate pause and the original pre-appeal\n\n 8   scheduling intervals. An accelerated schedule regarding future deadlines is therefore the most\n\n 9   equitable way to account for the substantial appellate delay while preserving Defendants\u2019 full\n\n10   opportunity to litigate on the merits. In short, the case should move forward with urgency\n\n11   proportionate to the time already lost.\n\n12           Defendant\u2019s Position: Defendants believe more time for discovery is warranted in order to\n\n13   give the Parties sufficient time to schedule all necessary depositions, taking into account\n\n14   scheduling challenges when there are multiple witnesses, including witnesses located in different\n\n15   parts of the country, necessitating travel.\n\n16           Defendants' proposed schedule otherwise is largely consistent with the schedule that was\n\n17   in place before the Court sua sponte issued the Stay Order. (See Dkt. 145.) Whereas that schedule\n\n18   contemplated 326 days between the cut-off for fact discovery motions and the pretrial conference,\n\n19   Defendants' proposed schedule below contemplates 329 days. By contrast, Plaintiff's proposed\n\n20   schedule truncates that time to only 196 days, imposing unrealistic timelines for the Parties and\n\n21   making it likely the Parties will have to come back to the Court to ask for more time.\n\n22           While the time between events in Defendants' proposed schedule largely tracks that of the\n\n23   Parties' most recent stipulated and approved scheduling order, in order to avoid potential\n\n24   scheduling conflicts from compressed timetables, Defendants propose to adjust the time between\n\n25   certain events as follows:\n\n26           \u2022      Add 13 days between the cut-off for fact discovery motions and the completion of\n\n27   fact discovery, for a total of 49 days (7 weeks), to allow a briefing schedule of 4 weeks for any\n\n28   oppositions and 3 weeks for any replies;\n\n     JOINT STATUS REPORT (No. 2:21-cv-01551-TSZ) \u2013 6\n                                                                             1301 Second Avenue, Suite 2000, Seattle, WA 98101\n                                                                               (206) 623-7292 OFFICE    (206) 623-0594 FAX\n\f            Case 2:21-cv-01551-TSZ           Document 156         Filed 01/28/26            Page 7 of 9\n\n\n\n\n 1          \u2022       Add 19 days between the completion of fact discovery and expert witness reports,\n\n 2   for a total of 29 days, to account for multiple expert reports from the Parties;\n\n 3          \u2022       Add 1 week between the exchange of expert witness reply reports and the\n\n 4   completion of expert discovery, for a total of 3 weeks, to account for the need to schedule multiple\n\n 5   expert depositions;\n\n 6          \u2022       Add 2 weeks between the completion of expert discovery and the deadline to file\n\n 7   dispositive and Daubert motions, for a total of 4 weeks, to allow sufficient time after the close of\n\n 8   discovery, including expert discovery, to prepare dispositive and Daubert motions.\n\n 9          Plaintiff\u2019s proposed schedule would give the Court limited time to rule on any dispositive\n\n10   motions prior to the start of trial. Plaintiff\u2019s proposed condensed timeline leaves just 4 weeks\n\n11   between the completion of dispositive motion briefing and the Parties\u2019 deadline to submit the\n\n12   pretrial order, motions in limine, trial briefing, voir dire, and jury instructions. Whereas,\n\n13   Defendants\u2019 proposed schedule allows over 4 weeks between the completion of dispositive\n\n14   briefing and motions in limine, and then an additional 4 weeks before the deadline to submit the\n\n15   pretrial order, trial briefing, voir dire, and jury instructions. Not only does this timeline offer the\n\n16   Court more time to decide any dispositive motion before trial, but it also prevents the Parties from\n\n17   expending time and resources preparing for a trial that may not be necessary.\n\n18          Further, for reasons that are not clear, Plaintiff has proposed to shrink the time between\n\n19   certain events, in a manner that Defendants do not believe is practical or feasible.
